The Terms of Service for Club Membership and Events

Terms of Service, Terms of Use, and Terms & Conditions are used Interchangeably in MG Classics Communications and have the same meaning, and relate to the information below:

Terms of Service

 

This website is provided "as is", without any representations or warranties, express or implied. MG Classics of Jacksonville (MG Classics) makes no representations or warranties in relation to this website, or the information and materials provided on this website.

 

Without prejudice, to the generality of the foregoing paragraph, MG Classics does not warrant that:

  • This website will be constantly available, or available at all; or

  • The information on this website is complete, true, accurate, or non-misleading.

 

MG Classics will not be liable to you, under the law of contact, the law of torts, or otherwise, in relation to the contents of, or use of, or otherwise in connection with this website, or other Online facilities supplied by MG Classics.

 

As a part of MG Classics Online presence, members in Good Standing will be given access to a secure list of members contact details. This may be accessed via the use of a personal login ID and Password, issued by the Webmaster, and unique to each member. The listing is available for contact with other members for the purpose of communicating about Club business and activities. Further, certain eMail Groups are available for the use of Officers, and other members of the MG Classics Management Team, to communicate information about MG Classics activities and other important messages to Club members. The use of these facilities to advertise personal businesses, owned by members, is strictly prohibited. Only businesses that support MG Classics through sponsorship may be advertised using Club facilities. Violation of these rules will result in access to use the Online services being withdrawn.

 

This website is provided free of charge. If you do not find the terms of use for this website, as defined above, acceptable then you must not use this website.

  

Release of Liability

 

It is the Entrant's privilege to participate in any MG Classics Event. In consideration for the granting of this privilege, on executing proper registration, and paying the entry fee, if any, the Registrant herby agree to the following release of liability:

 

"I hereby agree to participate in an MG Classics event. In consideration of the right, and privilege to enter, and participate, and other valuable consideration, and intending to be legally bound, I agree to release the MG Classics of Jacksonville (MG Classics), its Officers, the event committee, and members, from any and all liability for injuries, damage, or loss arising from my entry, attendance and participation in the event".

 

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge continues to evolve; the virus is known to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and droplets from contaminated persons via the air. People reportedly can be infected and show no symptoms and therefore spread the disease. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death. Various vaccines have been developed to mitigate the effects of the virus in people who contract the virus but it is known that vaccinated people can still spread the virus to others.

Members' Responsibility: Members and guests attending any MG Classics event must respect and safeguard the safety of themselves, their guests, and all other attendees by following the social distancing and hygiene recommendations as defined by the CDC and the State of Florida at the time of the event.

ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my family in order to join events organized by MG Classics of Jacksonville. These events are of such value to me and my family, that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to attend MG Classics events in person.

 

Registration and Insurance

 

All MG's and other Vehicles attending MG Classics events must have current Registration with Registration Tags displayed and have valid Insurance coverage. 

Privacy Statement

 

This website does use Cookies. The Cookies are used to enable you to access and navigate the website in a speedier fashion. The website cookies are not used to track website user's browsing history. Personal information posted on the site, such as an email address, telephone number, name, or address is done with the approval of the owner of the information. We do not pass on any personal information to third parties. We do however pass Club Roster details to other Club members. Third parties may access the public elements of the site, and view posted information. We cannot be held responsible for any action, or use of the information, by said third parties, including Club members.

 

MG Classics does use your email address to communicate details of Club meetings, events, and other necessary communications required for the efficient running of the Club.

 

By registering for any MG Classics event, or MG Classics supported event, you grant the MG Classics event Organizing Team the right to add your Registration Details to the MG Classics database to allow us to notify you of future MG Classics events, MG Classics supported events, or related events that the organizers believe will be of interest to you as a British Classic Car owner. You may unsubscribe from the database at any time by notifying the Organizing Team using the 'Contact Us' Form on this Website. Confidentiality is maintained per this Privacy Policy.

 

This website contains links to third party websites and information. We cannot vouch for the privacy policies of such third-party sites, and information obtained by them, as they are not covered by this privacy policy. You use such third party websites at your own risk.

Raincheck Policy

Rain or Shine Event: If an Event is Marked as a "Rain or Shine" event then pre-Paid Fees cannot be refunded. The event will take place irrespective of the weather unless conditions are considered dangerous. It is the decision of the Registrant if they wish to take part. If the event continues, and the Registrant decides to withdraw from the event, the Registrant will forfeit their right to a refund.​

Not marked as a Rain or Shine Event: If the event is not marked as a Rain or Shine event we may offer a Raincheck date or a Refund. In cases where an event required a fee paid in advance to enter we generally, but not always, offer to refund the registration fee.* 

In cases where advance payment was paid by Credit Card, using the Paypal Secure Payment Portal, Paypal charges a fee for the Credit Card payment processing. MG Classics only receives the Advance payment, less the Paypal fee. MG Classics will refund the event advance payment fee less the Paypal processing fee*.

* In cases where MG Classics has purchased awards specifically for the event that is not marked as a Rain or Shine event, and we cannot issue a Raincheck date, we assign a pro-rated portion of the total cost of the awards to each registrant eligible for a refund. This is a simple calculation: The 'Total Cost of the Awards/Number of Eligible Registrants'. The pro-rated cost is then subtracted from the Refund due each Registrant.
